 Conclusion of contract

1. The contract is concluded as soon as ENALINGUA has received an enrolment for the language course. Enrolment can be made online via the ENALINGUA web portal or by personally signing a teaching contract provided by ENALINGUA in the school office or by sending the teaching contract provided by email or fax.
2. By registering, the conditions of participation are recognised as an integral part of the contract. The contractual language is German.

Registration and terms of payment

1. Enrolment takes place by online booking via the ENALINGUA internet portal or by personally signing an enrolment/contract form provided by ENALINGUA in the school office or by sending it by email or fax.
2. The course fee must be paid before the start of the course in accordance with the registration and booking confirmation by bank transfer at the latest 1 day before the start of the course or by cash or card payment (at the latest on the first day of the course).
3. The one-off registration fee for each course is 50 EURO and is included in the course fee.
4. The one-off administration fee per course booking is 20 % of the course price and is included in the course fee.
5. According to § 125 (BGB) contracts can be concluded both verbally and in writing or in any other form, for example through non-verbal communication. This means that a verbal contract is also effective and binding for both contracting parties.

 All bank charges are to be borne by the customer (course participant).

Conclusion of the contract

1. By sending the online booking or signing the teaching contract provided by ENALINGUA, the participant recognises the General Terms and Conditions of ENALINGUA.
2. The price list valid at the time of registration is an integral part of the contract.
3. The course fees include: Placement test, language training and certificate of attendance as well as the one-off registration fee of EUR 50.00 and the one-off administration fee (20% of the course price).
4. Otherwise, i.e. outside the online ordering option via the ENALINGUA website, the contract between the customer and ENALINGUA is concluded by signing a teaching contract provided by ENALINGUA, which is also concluded exclusively subject to these GTC, at the ENALINGUA language school or by sending a signed teaching contract to an ENALINGUA language school by post or e-mail. The course or service to be booked shall be designated and described separately in the written teaching contract.

Course organisation

1. One lesson lasts 45 minutes.
2. All agreements regarding training times, training content, training duration and training fees are made exclusively with ENALINGUA and not with the trainers/teachers. The customer cannot engage the trainers/teachers of ENALINGUA himself, but must commission them exclusively via ENALINGUA. There is no entitlement to instruction by a particular teacher. ENALINGUA offers substitute teaching units or substitute programmes for cancelled teaching units (TU) or programmes.
3. Course participants are obliged to inform ENALINGUA immediately after discovering a defect and to demand remedy. In the event of non-compliance with this obligation, ENALINGUA excludes all claims.
4. A change of teacher may be part of the ENALINGUA method and does not entitle the course participant to cancel or withdraw from the contract.
5. ENALINGUA is not liable for the non-achievement of a certain learning and teaching success. The specifications made by ENALINGUA regarding the teaching units required to achieve a teaching objective are based on its own experience and may deviate from actual requirements in individual cases.
6. Additional agreements require written confirmation.
7. ENALINGUA reserves the right to change the course time (date or time) if necessary. The courses are usually organised with a minimum of 6 participants. 

ENALINGUA reserves the right:

1. to postpone the start date until there are enough (6) participants in the group course.

2. to reduce the number of hours to an appropriate level. 

3. to cancel the course if there are too few participants. In the event of a complete cancellation of the course, the entire course fees will be refunded. There is no entitlement to compensation. If a teacher falls ill, a replacement will be organised on the third day at the latest.

Withdrawal from the contract and cancellation by the customer

1. If a registration is made in connection with the application for a visa, all fees must be paid in advance. The course start date is the contractually agreed date according to the registration and booking confirmation. In addition, a processing and administration fee of 150.00 EURO will be charged for issuing a visa-compliant confirmation letter and sending it by email or post to the customer's home address. This additional fee will not be refunded under any circumstances. If the confirmation letter is only sent within Germany, the visa fee is 80.00 EURO.

2. Cancellation of the contract is not possible after a visa has been issued due to participation in the language course. This applies regardless of whether the language course is held in person or online.

3. If the visa for entry into an EU country is not granted and entry into the Federal Republic of Germany is therefore impossible, the course fee minus the registration fee of €120 can be refunded, provided that the original paper copy of the rejection notice is presented and the original registration certificate is returned.
4. It is possible to transfer the booked course place to another person on the same course date.
5. The course participant is responsible for ensuring that it is possible to enter the Federal Republic of Germany on the booked course date and that his/her stay in Germany is legal for the entire duration of the booked language course.

Rebooking:

1. If the customer requests a rebooking (e.g. change of training date, change of course type, change of course level), the rebooking should be made at least 7 days before the start of the course in accordance with the registration and booking confirmation. The rebooking fee is 50.00 EURO. Whether a course rebooking will be possible during the course is a matter of judgement and will be decided according to the respective situation.

2. All bank charges and transfer fees are to be borne by the customer (course participant).

Cancellations of individual lesson dates

Cancellations of lesson appointments must be made in writing to be effective.

1. Agreed individual lesson appointments can be cancelled by 12.00 noon of the previous day at the latest. In the event of a cancellation for Monday 

The cancellation must be made by 12:00 noon on Friday before the scheduled lesson date. Agreed lesson dates that are cancelled after this time or not taken without cancellation will be charged in full. Lessons that are not attended will not be refunded and cannot be made up for. This also applies to hindrances for which the participant is not responsible, such as illness or absence for professional reasons.

2. In the event of irregular attendance, illness or holiday of the course participant, the course fee will not be refunded. Participation in a language course at another time is a matter of discretion and will be decided on a case-by-case basis. There is no right to a refund if a course is cancelled.
3. Absences of the course participant during the course, e.g. due to illness, travelling, etc., will not be reimbursed.
4. ENALINGUA recommends taking out travel cancellation insurance.

Cancellation of the purchase contract due to visa-related reasons is only possible if an official notice of refusal from the competent authority is presented.

Liability

1. ENALINGUA shall not be liable for the cancellation of its services due to force majeure or other reasons for which it is not responsible.
2. ENALINGUA cannot be held liable for the loss of personal belongings in the school premises.
3. The course participant is liable for any damage he/she causes to the school facilities or classrooms.

Duty to co-operate/notification of defects

1. Before taking part in the course/examination, the participant must ensure that all technical requirements for taking part in the course or examination have been met.
2. The course participant or examination candidate is obliged to inform ENALINGUA immediately after discovering a defect and to demand remedy. In the event of non-compliance with this obligation, ENALINGUA excludes all claims.
3. Course or examination participants whose behaviour disrupts the course or course events may be excluded from further course attendance. In such cases, the course fees will not be refunded and will be retained.

Data safety

By registering, the course participant agrees that ENALINGUA may record and process his/her data electronically in order to properly carry out the registration, billing and performance record procedure.

Final provisions

1. German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). In the case of consumers, this choice of law shall only apply insofar as the protection afforded by mandatory provisions of the law of the state of the consumer's habitual residence is not thereby withdrawn.
2. Amendments and additions to the contract must be made in writing. Should any of the above provisions be invalid, the statutory provisions shall apply. The principle of the primacy of the individual agreement (§ 305b BGB) shall take precedence over consumers.

Miscellaneous

1. Changes and additions to these terms and conditions must be made in writing. ENALINGUA reserves the right to change the rules, the programme, the prices and the general terms and conditions without prior notice.
2. Should any point of these terms and conditions be or become legally invalid, the remaining provisions shall remain in full force and effect. Subject to printing and translation errors.
